Hendor Transport shall not use other than for the purpose of this agreement and shall keep strictly confidential and shall not disclose to anyone other that its employees and members who have a need to know the same for the purpose of this agreement and who agree to be bound by a similar obligation to secrecy:

1. Any commercial information relating to the business of your organisation obtained by us in the performance of the agreement.
2. Secret technical information belonging to your company and identified as such in writing.
3. The existence of this document and its contents.

The above obligation of secrecy shall remain in full force and effect until termination of this agreement but shall not apply to:

1. Information already in the possession of ourselves prior to receipt from yourselves.
2. Information subsequently obtained via a bona fide third party source in circumstances which did not restrict further disclosure.
3. Information which comes into the public domain other than through breach of this agreement.
